The 33-year-old man who was allegedly at the centre of a melee which ended in the death and injuries at a night spot on the Corentyne in December 2015, and is on trial for manslaughter, is expected to know his fate today.
Bhiron Robertson called “Bouse” of Liverpool, Corentyne, Berbice, is on trial before Justice Brassington Reynolds and a mixed Jury in the Berbice High Court.
He is charged with killing Mark Simon called Mark Lane, 28, also of Liverpool, on December 27, 2015 at Manchester Village.
Robertson, who was initially hospitalized following the melee, was also indicted for wounding Samuel Fraser, called “Charlie”, 32, of Liverpool.
Simon was reportedly hacked to death outside the Guinness Bar night spot at Manchester during the brawl. The fight broke out between Robertson and Simon, who were both reportedly involved in a relationship with a woman called Ann, or “Fluffy Tail” of Alness.
Robertson is being represented by Attorney at Law Arun Gossai.
The State’s case is being presented by Tuanna Hardy.
In her opening address, the prosecutor stated that there was a fight at a bar at Manchester, during which Mark Simon sustained a fatal wound to his thigh, and Fraser, who was acting as a peacemaker, was injured.
Joshua Smith of Liverpool Village testified that it was usual that the “Guinness Bar” hosted parties every Sunday at Manchester. Smith said that he was with his late uncle, Mark Simon and some friends, drinking at a table, when the accused approached and an argument ensued.
He spoke of seeing the two men becoming involved in a fight. He mentioned seeing a knife in Robertson’s waist, which he took and ‘juk Mark on his thigh’.
Detective Sergeant Michael Peters noted that he was told by the accused that “I did not chop Simon; it was Simon who chopped me with a cutlass on my head, my eyes, my back and my left foot.”
Detective Constable Corwin Mitchell testified to visiting the accused at the hospital where he noticed injuries on his back, left knee and head. His left foot was in a cast.
Woman Detective Deslyn Whyte testified to taking photographic evidence at the scene. Among items photographed were a stainless steel black handled knife, a pair of black- and-white sneakers, a red top, a black camouflage cap, and a grey gent’s vest.
Alice Simon, mother of the deceased, testified to identifying the body at the New Amsterdam Hospital mortuary.
Samuel Fraser told the court of his being present on the fateful day of the incident and of being injured during the brawl. He was subsequently hospitalized.
Policeman Albert De Mondenza recounted the part he played during the investigation.
Government Pathologist Dr. Vivikanand Brijmohan conducted the autopsy on the body and gave the cause of death as shock and haemorrhage along with a stab wound to the thigh.
Both the prosecution and defence closed their cases.
