Mohan Darapally, called ‘Rakish’ and ‘Brian’,32, a labourer of Cumberland, East Canje, Berbice has been sentenced to nine years in jail.
He appeared before Justice Brassington Reynolds on a charge of attempted murder. He however, pleaded not guilty to that charge, but guilty on a charge of causing grievous bodily harm with intent.
He is accused of committing the act on fellow villager, Fazal Hussain, a mechanic, on February 7, 2017 whilst they were at a wake at Angoy’s Avenue, New Amsterdam.
Attorney-at-law Seeta Bishundial conducted the state’s case.
According to the Prosecution, Hussain was at a wake house when Dharbali questioned his presence. Dharbali then proceeded to cuff him and lashed him to the head with a piece of wood.
Hussain fainted and was taken to the New Amsterdam Hospital where he was admitted for treatment. The Prosecutor stated that currently, the victim cannot hear from his left ear.
The accused pleaded guilty. Following his guilty plea, a probation report was ordered. The report which was presented by Probation and Social Services Officer Leesa-Ann Tucker stated that Dharbali was a school dropout.
He began working at age 14. He had previous brushed with the law and was jailed in 2012 on a charged for Break and Enter. As a child, he was often left unsupervised and would end up doing his own thing.
The accused told the court that he was sorry but claimed that on the day in question, Hussain attacked him and he acted in self-defence.
Hussein had asked for justice.
Before passing sentence, Justice Reynolds said the offence carries a maximum penalty of life imprisonment.
He referred to a United Nations report on life expectancy for Guyanese males, which is 63-years. Using 31-years, Justice Reynolds years reduced 15 and a further five for the accused early guilty plea.
He subtracted a further year for the favourable probation report. He thus sentenced the accused to nine years in jail.
