After hours of deliberation, a jury was unable to arrive at a verdict in the trial of Mahendra Bishundial, who is charged with the 2012 murder of Edun Farm Poultry employee, Aga Khan.
Bishundial had been on trial before High Court Judge James Bovell Drakes for the November 6, 2012 killing which occurred during the course of a robbery at Busby Dam, Craig, East Bank Demerara.
The jury was unable to arrive at a unanimous verdict for the capital offence, and as a result, Bishundial, who was further remanded to prison, will have to face another trial at the next sitting of the Demerara Assizes at the High Court in Georgetown.
Bishundial was represented by Attorney-at-Law Nigel Hughes. Prosecutor Mandel Moore presented the indictment on behalf of the state.
A police release had stated that Khan was attacked by four men, one of whom was armed with a handgun and others with knives. Khan was driving motor lorry GJJ 2806 owned by Edun Poultry Farms, east along Busby Dam, when the men walked into the path of the vehicle causing the driver to stop.
One of the men then approached Khan and demanded cash. He was shot to his neck in the process. Investigations were carried out and Bishundial was arrested and charged.
During the trial, the murdered man’s wife Sunita Jaigobin told the court that on the day of the killing her husband left home at around 07:00 am for work at Edun Poultry Farm. She said that around 17:00hrs that evening she received a call and as a result went to the Diamond Diagnostic Centre where she saw her husband lying motionless on a stretcher.
According to Jaigobin, the dead man was clad in a white T-Shirt with what appeared to be blood on it.
For his part, the deceased’s brother, Sharif Khan testified to identifying the remains of his brother to Government Pathologist Dr. Nehaul Singh on November 9, 2012 at the Georgetown Public Hospital Mortuary
Also testifying was Saeed Edun, who told the court that Aga Khan was one of his employees. According to the poultry farmer, on that tragic day, Aga Khan collected the keys to Canter truck GJJ 2806, while another employee uplifted the bill books and a cellular phone.
Edun said that around 17:00hrs that said day, he received a phone call from his wife which caused him to leave their home at Busby Dam. The witness said that the Canter truck was parked along the dam and he saw Aga Khan and another employee lying inside in a crouching position.
The poultry farmer recalled that he transported the injured men to the Diamond Diagnostic Centre, after which, he left for the Grove Police Station to inquired about what had transpired. He disclosed that a total of $48,000 was missing from the Canter truck.
