After Chief Magistrate Ann McLennan refused to grant businessman Abdul Imran Khan bail on several occasions, his lawyers were able to secure bail in the sum of $700,000 in the High Court.
Khan, 31, of 11 Austin Street, Campbellville, was not required to plead to the indictable charge which alleged that on October 28, last, at Main Street, Georgetown, with intent to commit murder; he unlawfully and maliciously wounded Romario Balget.
Khan who was on remand for over a month was granted bail by Justice Sandil Kissoon on December 4 last, pending the outcome and determination of the Preliminary Inquiry (PI) which will be conducted before Senior Magistrate Leron Daly.
Yesterday when the matter was called in the courtroom of Magistrate Daly, Special Prosecutor Latchmi Rahamat, told the court that despite Balget being released from hospital, his injuries are still life-threatening.
The Prosecutor went on to tell the court that Balget has an artificial tube, but before she could have completed her sentence, Attorney-at-Law Glenn Hanoman interrupted her and told the court that the Prosecution is misleading the court and has no medical report to show the injuries the victim sustained.
However, the Prosecutor told the court that she has provided a medical report to the court, outlining the injuries Balget received, allegedly at the hands of Khan.
On November 26, last the Prosecutor had told the court that Balget had to be admitted once again at a private hospital after suffering a seizure.
Rahamat added that a CT scan had to be conducted on Balget, since it is believed that he might have suffered a fractured skull during the alleged beating, which is the likely cause of the seizure.
The Magistrate after listening to both sides adjourned the matter until January 8, 2019 for full disclosure.
According to information, on the day in question around 02:00 hrs, Balget went to the Palm Court night club on Main Street where he and his friends spent an hour.
It was reported that as Balget and his friends were about to leave the nightclub, Khan and some other men were standing at the gateway. As a result, Balget and his friends walked between Khan and his friends.
The court heard that Khan became annoyed and dealt Balget several punches to his head and face, causing him to sustain injuries.
Khan then allegedly continued to cuff and kick Balget, while Balget was lying on the ground in an unconscious state. He is then alleged to have picked up a bottle and slashed Balget across the right side of his face.
The injured man was rushed to a private hospital where he underwent two emergency surgeries for the injuries he received.
