Kaieteur News – The Caribbean Court of Justice (CCJ) on Wednesday stayed extradition proceedings against businessman Azruddin Mohamed and his father Nazar ‘Shell’ Mohamed.
Attorneys representing sanctioned the businessmen secured a major legal victory, bringing a temporary halt to ongoing extradition proceedings.
Speaking shortly after the hearing, defence attorney Siand Dhurjon revealed that the CCJ granted a stay of proceedings, citing the “interest of justice” as the driving force behind the decision.
According to Dhurjon, the court not only treated the matter as urgent but also approved all orders sought by the defence, including having the special leave application heard simultaneously with the appeal.
“The CCJ is obviously very concerned about what’s happening,” Dhurjon stated, adding that the court moved to preserve the status quo and protect the liberty of the Mohamed family.
The stay will remain in effect until the CCJ fully hears and determines the matter. Dhurjon explained that should the court rule in their favour, it would result in the dismissal of the authority to proceed—signed by the Minister—which forms the legal basis of the case before the magistrate.
“If that is dismissed, it effectively kills the proceedings before the magistrate,” he noted.
The matter is set to return to the CCJ on April 21, where both sides will present arguments.
