Dear Editor,
My attention was drawn to a letter written by Pat Robinson Commissiong published in the Kaieteur News, May 31, 2018. Denuded of its esoteric content, I apprehend the writer’s query to be;
1) why the Judicial Review Act was not brought into force during the PPP Adminstration; and,
2) what period did I serve as Attorney General and Minister of Legal Affairs?
The singular reason why the Bill was not operationalised in 2010 (and before May 2015) was because the Rules of Court, in force then, were silent on judicial review and the procedure by which judicial review is to be applied for. The remedies which the Act provides were to be accessed, are contained in the new Civil Procedure Rules (CPR), which were then in draft.
As a result, the draftsman resided a power in the Legal Affairs Minister to bring the Act into force by an Order, when the CPR is promulgated. The CPR was promulgated in February 2016.
The Chief Justice so found in her ruling. I served as Attorney General and Minister of Legal Affairs from December 2011 to May 2015.
