Candace Marshall, one of the three women convicted and jailed for embezzling over $48M in credit from Telecoms Solution Inc, has been granted $500,000 bail pending appeal.
Marshall, 31, of North Ruimveldt, Georgetown; Melissa Naughton,39, of Robert Street, Better Hope, East Coast Demerara and Oladara Christian, 32, of Shell Road, Kitty, Georgetown, were found guilty of conspiring together with other persons to embezzle in excess of $48M in credit from the company.
They were each jailed for four years’ by Magistrate Leron Daly on October 4, in the Georgetown Magistrates’ Courts.
According to court facts, the women were employed with the company. Naughton and Christian were employed as cashiers and were responsible for selling large amounts of Digicel credit via a computerized system.
The women invalidated several transactions which were written off, after which they revalidated the transactions and sold them to persons to receive the proceeds for themselves.
An investigation was launched and it was revealed that Marshall sold the credit to persons but never deposited the money into the company’s accounts. It was Marshall who solicited customers from time to time.
The petition for admission of bail pending appeal after conviction and sentence was made by Attorney Kim Kyte before Justice Roxanne George at the High Court in Georgetown on October 25.
According to the Affidavit in Support of the petition, Marshall has to report to the Brickdam Police Station every other Friday. Failure to comply with this order will result in her immediate arrest.
During her ruling in this matter, Magistrate Daly asserted that she would impose a custodial sentence on the women based on the quantum of money stolen and nature of the offence, despite their lawyers appeal for non custodial or suspended sentences.
The Magistrate said that she considered the fact that the women were of sound mind and understanding when they committed the offence. Magistrate Daly also pointed out that they were also mature enough to understand the consequences of their actions. She said that her court as well as society strongly condemns theft, and said that although the women were mothers, they must be punished for what they did.
