(Kaieteur News) – Dem boys seh in Guyana, if yuh unfortunate enough to be involved in a fatal accident, the accident does not end when the ambulance leave. Oh no! That is when the second accident start — this time between you and the police station bench.
Apparently, once somebody dead in a road accident, the driver must spend the night — and sometimes several nights — behind the station door. Whether the driver reckless, negligent, careless, simply unlucky, or nat at fault at all, apparently the first order of business is: “Bring he in and lock he up!”
Dem boys seh, whatever happen to Notice of Intended Prosecution? Whatever happen to placing the driver on station bail? Because there is a big difference between being investigated for an offence and being treated as though the court already find yuh guilty.
Imagine a driver involved in a terrible accident. Somebody dead. The driver may be shaken, traumatised, confused and wondering how his life could change in one terrible second. Instead of getting the opportunity to contact his family and lawyer, he gets a mattress made from two chairs and a police station fluorescent light for company.
A fatal accident can be caused by negligence, recklessness, mechanical failure, road conditions, weather, visibility or the conduct of another road user. Sometimes the driver locked up is not at fault al . That is why investigation is important. Evidence must come before judgment.
If the police have reasonable grounds to believe an offence was committed, prosecute the person. If the law permits bail, let bail be the norm rather than the exception. If there are circumstances requiring detention, explain and justify it according to law.
Dem boys seh justice supposed to be blind — not because it can’t see, but because it should not prejudge. We must never allow the understandable emotion surrounding a fatal accident to turn investigation into punishment.
Because when the police station bench becomes the first courtroom, dem boys seh Guyana got more than a traffic problem.
We got a justice problem.
