DEAR EDITOR,
We refer to our conversation on January 31, 2020 and to the article published in the Kaieteur News on January 31, 2020 by Kiana Wilburg entitled “Sale of Govt. 20% shares in GTT…High Court orders seizure of US$3.2M from GTT bank account’ (hereinafter referred to as the ‘article’).
The title of this article is libellous as it intimates to the public that there was resistance on the part of the Guyana Telephone and Telegraph Company (‘GT&T’) to pay the sum of US$3,200,000 to the National Industrial and Commercial Investments Limited (‘NICIL’). Firstly, GT&T has been compliant with the Court Orders that have been made in this matter. We are able to confirm that the monies have been paid into the High Court Registry on January 27, 2020 in accordance with the order. The primary respondent to NICIL’s claim is Hong Kong Golden Telecom Company. GT&T has been joined in the proceedings as an interested party.
As you should be aware, garnishment orders provide direction to individuals or companies to make payments to a creditor in a matter of this nature on behalf of this debtor. To impute that GT&T’s monies had to be taken from it or seized from its bank account is misleading, spurious and baseless.
Your article denigrates the public image of the financial standing and reputation of the Guyana Telephone and Telegraph Company. To that end, further to your discussions with our Jasmin Harris, you have agreed, on behalf of Kaieteur News, that the newspaper will issue the following:
i. a retraction and apology pertaining to the contents of the article by way of electronic media within twelve (12) hours of receipt of this letter by way of email that is to be sent to Messrs. Adam Harris and Nigel McKenzie; and
ii. a retraction and apology within contents similar to that noted in (i) to be published in February 1, 2020 edition of the Kaieteur News.
We trust that the aforementioned steps will be taken. Your unwillingness to do so will unfortunately result in us commencing legal proceedings against Kaieteur News.
We trust that you will comply as we work towards building meaningful relationships with Kaieteur News and the media fraternity.
Sincerely,
Mark Reynolds
VP, Legal & Regulatory Affairs
