guilty by a jury for having sexual intercourse with an underage girl. The man, Gingesh Khan, 52, of Vergenoegen, East Bank Essequibo appeared at the High Court in Georgetown before Justice Brassington Reynolds who imposed the sentence.
About three weeks ago, a 12-member mixed jury found him unanimously guilty of the crime which was carnal knowledge which he committed on a nine-year-old girl between August 1 and August 31, 2008, in Demerara. Khan, who was represented by Attorney-at-Law, Rabindra Mohabir, had initially pleaded not guilty to the charge.
Kaieteur News understands that Khan went into the little girl’s home while her parents were not at home and molested her. The child later complained to her parents about what had happened and a report was lodged with the police. Investigations were carried out and Khan was arrested and charged for the crime.
Following the presentation of a probation report, the court was told that Khan still insists that he did not rape the girl, who is now an adult. According to a probation officer, residents in the man’s community said that he was in the habit of sexually molesting their livestock. He was at one time charged for bestiality.
The probation officer told the court that although the incident happened over a decade ago, the victim told her that she still has flashbacks, and that the incident has affected her relationships. According to the victim, she still feels hurt, ashamed and embarrassed. She told the judge that everyone in the community knew of the incident and this led to her relocating.
According to the probation officer, Khan growing up in a broken home was no excuse for him committing such an act. She said that persons like him should be separated from society to avoid them from preying on the vulnerable.
The victim said that Khan was someone known to her family and she still does not understand why he would want to hurt her in that way.
She said, “I am now involved in church activities to get over what happened. I need justice. I need him to be locked away so he cannot do what he did to me to anyone else.” She said that the incident has brought about suicidal tendencies in her.
While Khan did not address the court, his lawyer Rabindra Mohabir told the court that his client has no previous convictions. The lawyer was keen to point out that while his client was charged for allegedly engaging in sexual activity with a horse, he was never convicted; the matter was dismissed.
Noting that the penalty for this offence attracts a life sentence, Justice Brassington Reynolds told Khan that he was a “very sick” man. According to the judge, Khan expressed no remorse whatsoever and to top it off he was accused of bestiality. The judge said that the victim’s impact statement was a very painful and emotional one.
The judge pointed out that Khan was known to the girl’s family, but instead abused his position of trust when he groomed and violated the child in the vilest manner.
Nevertheless, Justice Brassington advised the convict to use his time in incarceration to reflect on his wrongdoings. The case for the State was presented by Prosecutors Lisa Cave, Seeta Bishundial and Sarah Martin.
