There is Sir Fenton/Jacob Rambarran’s case, which should be heard in our Appeal Court, since it is an important case. The Broadcast Authority is acting as if it is a legal entity when this case which is still sub judice.
The challenge says that the Broadcast Bill 2011 which was passed through parliament in 2011 when the PPP had a majority of the seats in parliament, was actually brought into effect in 2012 when the PPP had lost the control of Parliament to the opposition.
This meant that the PPP did not have the power to activate the Act.
This case must be heard; we all have to demand it, since the following can happen in this country, 4 men can run in an election and three of them get 24 % of the votes and the fourth gets 27%.
Incredibly GECOM is obligated by our Constitution to declare the person with 27% of the vote as the president, but Sir Fenton is saying in this case that he would not have the right to form a government, since he does not control parliament, so he would have to come to some sort of arrangement with one of the other parties with 24% of the vote plus his 27%=51% before he can form the government.
Currently the Broadcast Authority is demanding $2.5 million worth of Broadcast fees when in fact the matter is still sub judice and is not enforcable.
