Dear Editor,
I herein wish to make the following comments on the Stabroek News Editorial, “Travesty” published on Thursday March 30, 2017 in reference to the matter The State v. Wesley Carlos Payne called “Piggy” for Rape and Robberies.
At the outset, Iam in total agreement that the 2 victims, especially the raped victim, indeed suffered a grave injustice when the accused was allowed to walk out of Court a free man. Suffice it to say, the verdict by the 12-member jury must have been shocking and disappointing to the prosecution as it was to the victims, their families and friends.
That being said, I feel compelled to make the following comment and point specifically to the following:
Paragraph 3 line 5 which reads, “Add to this mix green prosecutors, who may only have been assigned to a particular case when it came to trial and you have a recipe for acquittal and for the survivor/complainant feeling defeated and wondering whether reporting the crime and giving evidence in court-acts which require a tremendous amount of courage –were worth it after all.”
It begs the question and I have interpreted ‘green’ prosecutors to mean prosecutors with little or no experienceprosecuting matters in the High Court. Now, if this is so, how then would you account for the same mix green prosecutors going back to Court the day after “Piggy” walked free and successfully prosecuting two other sexual cases, one for the offence of Carnal Knowledge and the other for Sexual Activity with A Child Family Member,” two offences with no lesser traumatic experience than that which damages the psyche of a rape victim.
These “green prosecutors” must be commended for the work they do in seeking to bring justice to victims and their families given the sometimes unprofessional and sloppy investigations the police hand to them as core evidence to work with.
