Chabilal Hardiyal was yesterday found guilty of trafficking in narcotics, six years after he was caught with cocaine at the Cheddi Jagan International Airport.
Hardiyal will now have to spend the next three years in jail.
On October 3, 2003, Hardiyal was found with nearly nine kilograms of cocaine, hidden in the sides of his suitcase.
He was searched after security grew suspicious of the weight of his luggage. Subsequent examination of the bag uncovered the controlled substance in the sides of the luggage. The convict appeared before Magistrate Maxwell Edwards at the time (2003), and pleaded not guilty.
Vic Puran, the lawyer representing Hardiyal, had raised legal issues, and the matter was stalled for some time. The case was then reassigned to Acting Chief Magistrate, Melissa Robertson, in November 2007.
Hardiyal was heading to Barbados that same day (October 3, 2003) when he was arrested. Puran, who represented Hardiyal right up to the time of his sentencing, stated that his client had been present everyday, for all these years, and so asked that the minimum sentence be imposed.
The magistrate subsequently fined Chabilal Hardiyal $10,000, and sentenced him to the mandatory three years’ imprisonment.
