(Kaieteur News) – Guyana is set to receive a decision in the failed parking meter project case between the government and Smart City Solutions Holding, Inc.
In 2016, the Georgetown Mayor and City Council signed the controversial parking meter contract with Smart City Solutions Holding, Inc. The project was abandoned due to massive protest and public opposition. Smart City Solutions Holding, Inc. the company hired to implement the project had filed a lawsuit claiming US $100 million.
Providing an update on the matter on his programme ‘Issues in the News,’ on Tuesday night, Attorney General, Anil Nandlall, SC said hearings into the case commenced on Monday, September 29 and concluded on Saturday, October the 4, at the International Arbitration Center of Paris.
Nandlall explained that “The hearings included the testimony of several witnesses, fact witnesses as well as expert witnesses from both sides. It included the examination in chief of these witnesses as well as the evidence adduced from them through cross examination.
After that process was concluded then both sides were invited to make their closing arguments. Of course, both sides presented their respective line of witnesses and upon the conclusion of the adjustment of evidence, the tribunal then invited the legal team from both sides to present their closing arguments.”
According to the AG, the tribunal has resolved its decision for a date to be announced.
“Of course, the parties will be informed in due course of that date and that date obviously will be made public so that the public continues to be updated onthis important matter,” he said.
The case was registered with ICSID on December 22, 2021. A tribunal to hear the matter was constituted on September 20, 2022, comprising Dr. Campbell Alan McLachlan KC of New Zealand as president, with arbitrators Stephan Schill of Germany, appointed by the claimant, and Marcelo Kohen of Argentina, appointed by the respondent. Guyana is represented in the proceedings by the Washington-based law firm Foley Hoag and the Attorney General’s Chambers.
