The Police Service Commission has made the long awaited decision to reinstate wrongfully dismissed Police Superintendent Simon McBean after 10 years of being out of the force.
McBean who was a Superintendant under the then Commissioner of Police, Henry Greene, had received a letter of dismissal from the secretary of the Police Service Commission.
The letter stated that McBean was dismissed with effect from December 25, 2007, for what the PSC described as his unauthorised participation in a Master’s Degree course in Global Security and Policing at the University of Leicester in the United Kingdom.
It further stated that he breached proceedings and regulations but did not stipulate what proceedings and regulations were breached.
McBean had applied to the Guyana Police Force Administration for study leave but got no response. He then applied for no-pay leave and also got no response.
McBean then applied for annual leave, which was in excess of 100 days and was granted this leave.
He used his annual leave to travel to England. During his time there, he got ill and submitted sick leave. He claimed was unable to return to Guyana at the end of his annual leave. He was able to complete his Master’s Degree.
McBean took his dismissal to court and on April 6 2018, won his appeal at the Appeal Court that his dismissal from the GPF was unlawful.
Legal action was taken against a decision by former Acting Chief Justice Ian Chang to dismiss a civil suit brought against the Police Service Commission (PSC) and the Attorney General over the dismissal.
The matter was recently reviewed by the PSC and the decision was made to have him reinstated with immediate effect. After living abroad for some time, he returned to Guyana and had expressed his interest in being a part of the force once again to share his knowledge garnered over the years he was robbed of being a policeman.
When McBean was dismissed he had served only 17 years in the GPF, it has been ten years since he was wrongfully dismissed. He will return as a Superintendant but according to the PSC, he will receive all promotions and benefits that would have accrued to him over the years.
