The High Court has ruled in favour of a miner who has been battling the Guyana Geology and Mines Commission (GGMC) over a number of claims at Aranka, Region Seven.
According to court documents, Prince Bowman, an East Coast Demerara resident, has been operating a number of claims in the Aranka, Region Seven area for a number of years.
The claims were in the name of Jerrol Hanover.
However, several months ago, GGMC moved to take the lands away, saying that that claims were null and void.
Bowman had reportedly found promising signs of a significant deposit of gold.
The miner went to court and through his lawyer, Madan Kissoon, filed an application for an Order or Rule Nisi of Certiorari and an Order of Prohibition and Mandamus.
It was heard in July by Justice Navindra Singh.
Bowman argued that according to the Mining Act, he is the lawful person entitled and person in occupation and beneficial person to the claims.
Justice Singh agreed and granted the orders quashing the GGMC decision to deem the claims null and void.
The orders also stopped GGMC and its officers from publishing in the Official Gazette that the mining claims were null and void.
On Friday, GGMC through its lawyer, Ralph Ramkarran, appeared before the courts again, this time in front of Justice Fidela Corbin to stay the orders.
But the court again decided in Bowman’s favour.
