Chief Magistrate Ann McLennan on Tuesday remanded a 22-year-old Kitty resident to prison, after he
was charged with having an illegal gun and matching ammunition in his possession.
Mark Calvan of 222 Pike Street, Kitty Georgetown, who appeared in the Georgetown Magistrates’ Court, is alleged to have had a .32 pistol in his possession when he was not the holder of a firearm licence. It was further alleged that he had three .32 live rounds of matching ammunition in his possession.
Calvan, a labourer, was allegedly found with the items on January 28, last, at Georgetown.
Although he pleaded not guilty to the charges yesterday, he was remanded to prison after Police Prosecutor, Deniro Jones, strongly opposed bail.
The Prosecutor told the court that on the day in question, around 21:00hrs the police were performing patrol duties at the corner of Cummings Street, when they observed the defendant and another man acting in a suspicious manner.
Jones said that as police approached them, Calvan ran away but was later apprehended and searched. According to Jones, the gun along with matching rounds was found in his crotch.
During a bail application for Calvan, Attorney Paul Fung-a-Fat argued that the police have no evidence to link his client to the firearm because it was not found in his possession. He told the court that on January 28, his client and another man were arrested by police. However, he said that the other man managed to escape and throw the gun into a nearby canal.
Fung-a-Fat stated that his client was later placed in police custody and charged for the offences. The Attorney pleaded for Calvan to be admitted to pre-trial liberty citing the fact that the prison is overcrowded which could lead to prisoners staging riots.
He also pointed out that the defendant never provided the police with any oral or written confessions to the crime.
Prosecutor Jones maintained his objections on the grounds that no special reasons were put forward by the defence for bail to be considered by the court. Jones noted that Calvan is a flight risk since he had provided the police with an address of Lot 10 Pike Street, Sophia at the time of his arrest.
But Fung-a-Fat sought to justify why his client had given different addresses. He explained that the defendant would stay at both addresses from time to time with his family.
In spite of the explanation, Calvan was still sent to prison and ordered to return to court on February 15, for reports and fixtures.
