Hire-car driver charged with causing death by dangerous driving freed on bail
David Livan, 52, a hire-car driver who was involved in the accident that claimed the life of Navindra Seeram, was released on $200,000 bail on Wednesday before Magistrate Faith McGusty at the Anna Regina Magistrate’s Court.
Livan was charged indictably with causing death by dangerous driving, and Prosecutor Oswald Pitt requested that the offence remains indictable.
According to the police, on February 14 at Hibernia, Livan drove his car, HB 2139, in a dangerous manner causing Seeram’s death.
In an application for bail, Counsel Dindyal, said that his client was gainfully occupied as a hire-car driver for the last 34 years. He also said that ever since the incident his client has been hospitalised, suffering from the injuries he received to the head, eye and about his body as a result of the beating he got from irate residents of Hibernia.
Prosecutor Pitt was adamant, though, that the driver should be refused bail. In his submission he said that a life was lost and as such the offence is a serious one which carries a custodial penalty.
He noted that Livan had previous matters before the court and was always reluctant to attend those trials, and as such he poses every chance of being a flight risk.
