Magistrate Hazel Octive-Hamilton yesterday granted bail to a man who appeared before her charged with simple larceny.
Kawal Bhim is accused of stealing a pair of sneakers and other personal effects, property of Clifton Stuart. To the charge Bhim pleaded guilty.
Police Prosecutor Robert Clement told the court that on the day in question, Stuart, who is a security guard employed at Shivnauth Construction site, left his post and upon his return found the items gone.
According to Clement Stuart, he had gone to a nearby shop to buy a soft drink and when he returned he noticed two men in the compound.
At his presence one of the men ran, leaving the accused who was arrested and handed over to the police.
Bhim then told the court that on the day in question the ‘real thief’, who was in the guard hut posing as the security guard, called him and asked him to purchase a drink for him.
He said while he was at the gate waiting for the money to go purchase the drink, Stuart came up and enquired what the two men were doing at his post.
“Your worship when the real security guard turn up he ask the thief security what he doing there and he tell de real security that he is de security but when he see de real security open the gate with the key he run away with a bag in he hand and I left standing up by de gate,” Bhim explained.
As such Bhim said the only alternative the real security guard had was to hold onto him.
After listening to his explanation the Magistrate told the accused that she would enter a not guilty plea for him.
He, however, insisted that he wanted to maintain his guilty plea since he lives on the road and can’t afford to post bail.
Despite this the magistrate entered the not guilty plea and granted the accused $10,000 bail. Bhim is expected to make his next court appearance on August 24.
