(Kaieteur News) – The Caribbean Court of Justice was supposed to be the region’s last fortress of justice—the institution citizens could turn to when confidence in their own systems had been shaken. But the explosive allegations now surrounding the Court threaten to turn that fortress into a house of suspicion.
This is not a matter that can be dismissed as routine internal discussion, as the Bar Council in Guyana has suggested. Allegations of “panel manipulation” and attempts to influence judicial opinions are far too serious to be reduced to differences among judges or the normal rough-and-tumble of judicial deliberations.
They go to the heart of judicial independence.
Even more troubling are reports that five of the Court’s six sitting judges raised serious concerns about the conduct and leadership of the President of the Court. Five judges cannot simply be waved away as disgruntled colleagues who misunderstood the circumstances. Nor should the public be expected to accept assurances from the institution itself as the final word on allegations involving its own leadership.
The Court cannot credibly investigate itself.
That is precisely why an independent investigation into the CCJ and the allegations surrounding its President is now imperative.
This is not an attack on the CCJ. It is a demand to protect it.
The Caribbean cannot afford an apex court whose judgments, however legally sound, are increasingly viewed through a cloud of suspicion. Once citizens begin asking whether judges were selected for particular panels because of the decisions they were expected to reach, the damage goes far beyond one case or one dispute.
It strikes at the credibility of the entire institution.
And Guyana has an especially compelling interest in getting to the bottom of these allegations.
The CCJ’s reputation rests not merely on the qualifications of its judges or its lofty declarations about judicial independence. It rests on public confidence that every litigant receives a fair hearing, every panel is constituted properly, every judge is free from improper influence, and every decision is reached according to law and evidence.
If there is nothing to hide, an independent investigation should pose no threat.
Indeed, it would strengthen the Court.
The investigation should be conducted by persons completely independent of the CCJ, with the authority to examine the leaked correspondence, the conduct of the President, the allegations of panel manipulation, claims of attempts to influence judicial opinions.
The CCJ was created to inspire confidence in Caribbean justice. That confidence cannot be demanded; it must be earned and constantly protected.
This is bigger than personalities. Bigger than institutional pride. Bigger than the reputation of any individual judge.
The integrity of the Caribbean’s highest court is at stake.
Investigate the allegations. Establish the truth. Clear the Court if the allegations are unfounded—or hold accountable anyone responsible if they are not.
Anything less risks leaving the CCJ permanently under a cloud. And that would be a tragedy for justice throughout the Caribbean.
