Berbice man acquitted in child rape retrial

(Kaieteur News) – Krishna Tulapersaud, who had been accused of engaging in sexual activity with a child, was on Friday freed after one charge was dismissed for lack of evidence and a jury found him not guilty on the other.

The Plegt Anker, East Bank Berbice resident was retried before Justice Simone Morris at the Berbice High Court, where he pleaded not guilty to both indictments.

Tulapersaud was first tried and convicted in 2018, when he was sentenced to life imprisonment. However, the Court of Appeal later overturned the conviction and ordered a retrial.

He had been indicted on two counts of sexual activity with a child family member. The first offence was alleged to have occurred in February 2013, while the second was said to have taken place in February 2014.

Before the retrial, Tulapersaud had spent eight years in prison.

The retrial began on June 10, 2026. State Counsel Marisa Edwards prosecuted the case and called six witnesses. Tulapersaud was represented by attorney Arudranauth Gossai.

At the close of the prosecution’s case, Justice Morris upheld a no-case submission on one of the counts, ruling that there was insufficient evidence for the matter to proceed. The 12-member jury was then directed to return a formal verdict of not guilty on that charge.

The remaining count was left to the jury, which also returned a verdict of not guilty.

With both charges resolved in his favour, Tulapersaud was acquitted and released from custody.
