(Kaieteur News) – The Mayor and City Council has moved to the Courts seeking an injunction against the Government of Guyana, over the City Constabulary Training Complex at Water Street.
Mayor of Georgetown Alfred Mentore made the disclosure during Friday’s pres conference hosted by the A Partnership for National Unity (APNU).
Providing insight on the legal submission to the media he said that, the council’s main argument on the matter is to address the trespass, and the government’s attempts to take over the asset, owned by the City Council.
“So, we’ve moved for injunctive relief, to ask the court…to ask them… for them to grant us the necessary relief. So that we could have back our property and so that we could be able to have access and be able to determine what is the best use for that property. So, the injunctive relief in itself, we’ll be praying to the court to remove government from the property,” he said.
Mentore went on to explain that the Council is also hoping that the security firm Roshan Khan Security Services, who has been providing guard services can also be removed, and the Attorney General backs off of the matter, since the property will remain in the City’s possession.
He clarified, “Well yes firstly we’ll have to get the injunctive relief. So, when the injunctive relief is hopefully granted by the courts, taking into consideration the facts that was presented by our attorney in these matters, they could then look at how else they want to continue in the pursuit of dealing with this matter. But as it stands the position is we are moving for injunctive relief to remove those persons that happen to be there and to gain back the access to our property.”
Mentore stressed that the Council does not want a tug of war, hence it is asking the courts to deal with the matters, and allow good sense to prevail. “One who alleges must prove, and if one is claiming ownership of a property then the title must be provided. What we are saying is, that is ours and is the property of the Mayor and City Council and we have provided whatever title towards this property, and that is what will be the contention. So, our attorneys will be relying on such evidence, relying on such facts to be able to provide that evidence to the court, and to erase any doubts as it relates to who owns the property and who it concerns,” the mayor added.
On March 28 this publication reported the dramatic standoff between city officials and members of the Guyana Police Force at the property.
The tense scene developed after Councilor Clayton Hinds attempted to enter the facility but was stopped by officers stationed at the entrance. A “no trespassing” sign had been erected, and police maintained a firm position that no one would be allowed inside.
Mentore later arrived on the day and questioned the authority under which the restriction was imposed, insisting that the property belongs to the council and that no approval had been granted for such action. His attempts to get answers from the officers were unsuccessful. A senior police official on site stated only that he was acting on “directives from above,” refusing to identify who issued the orders. He maintained that the sign would remain in place and access would continue to be denied.
Mentore had condemned what he described as an alarming abuse of state power. “I just want people to understand the nature of the government that we’re dealing with… This bullyism that is in the school, is the same bullyism that is there nationally,” the mayor said then.
