The ghost in the machine: A tale of two AIs and the struggle for human agency

The modern individual exists within a paradox of autonomy. While we celebrate the “digital age,” we are increasingly caught in a crossfire of algorithmic warfare where the human subject is both the target and the casualty. The rapid integration of Artificial Intelligence into corporate retention strategies has birthed a perilous new frontier: the weaponisation of psychological vulnerability.

Recent legal actions by the Federal Trade Commission (FTC) and the Department of Justice against multinational giants like Adobe and Gen Digital Inc. (owners of Avast and Norton) underscore a systemic shift toward predatory “dark patterns.” These corporations utilise decision architectures designed to induce “digital duress.” Whether through “scareware” pop-ups on a private computer screen or relentless, AI-driven email funnels, the goal is the same: to coerce a subscription that is deceptively easy to enter but a “nightmare” to exit.

The Mechanics of Automated Predation These platforms often penetrate the sanctuary of the private home through seemingly useful apps or “free” security trials. Once the billing information is secured, the “Negative Option” trap is set. Statistics reveal a 130% surge in these aggressive retention tactics globally. When a user attempts to exercise their right to cancel, they are intercepted by a “Retention AI”, an algorithm programmed to ignore human intent, utilising convoluted loops, “ambush” fees, and persistent resistance to wear down the consumer’s resolve.

The impact is not merely financial; it is physiological. To be trapped in a high-pressure confrontation with an unyielding digital agent, especially for those with existing medical vulnerabilities, is a form of automated harassment. It represents a profound erosion of human agency by a state-corporate apparatus that views psychological distress as a mere variable in a profit equation.

The Paradox of Defensive AI Perhaps the most striking irony of this era is that to reclaim one’s agency from a predatory AI, one must often turn to a defensive one. We are witnessing a de facto recognition that algorithms now mediate our world so thoroughly that human logic alone is no longer a sufficient shield. To fight back, individuals are now utilising “digital interlocutors”, defensive AI services, to articulate legal demands, navigate complex regulations, and level a playing field tilted by massive corporate legal departments. Paradoxically, to exercise our autonomy, we must return to the very technology that threatens it. We are “the people in between” the AI wars, using one form of code to neutralise the unethical architecture of another. A Call for Cognitive Liberty This shift suggests that traditional consumer protection is obsolete. We must move toward a scholarly and regulatory framework that recognises “Algorithmic Harassment” as a formal violation of cognitive liberty. Intellectual vigilance is required to ensure that our digital tools serve to empower the individual rather than diminish the human spirit through automated coercion.

The struggle for agency in the 21st century will not be fought on traditional battlefields, but within the lines of code that dictate our daily interactions. We must learn to command these tools, or be prepared to be commanded by them.
