Convicted rapist, Calvin Ramcharran, has moved to the Appeal Court in a bid to have 23-year prison sentence imposed on him, overturned.
Ramcharran also wants his conviction set aside, some five years after he was found guilty by a mixed 12-member jury in the Georgetown High Court.
In 2015, Ramcharran was convicted of sexually penetrating a 20-year-old female without her consent. He is also convicted of assaulting the woman and causing her actual bodily harm during the commission of the crime.
The incident occurred on July 22, 2012. Ramcharran and the victim were at a dance in Soesdyke, when he followed her behind an old house and attacked her.
On the night of the incident, Ramcharran had asked the woman: “Whether she was doing business” and although she told him no, he pursued her and forcefully had sexual intercourse with her.
Following a trial before Justice JoAnn Barlow at the High Court, Ramcharran was found guilty of both offences. A mixed jury returned to the courtroom with guilty verdicts for both offences after just a few hours of deliberation.
Back then, his attorney, Sonia Parag, subsequently implored the court for leniency on behalf of her client. She noted that Ramcharran is still a young man, who can yet make valuable contributions to society.
However, Justice Barlow noted that the convict had violated and beaten his victim before raping her.
She, therefore, underscored that while society would consider that Ramcharran is young, society would hope that its voice is heard through the court.
As such, the Judge sentenced Ramcharran to 23 years for rape and four years for the assault charge.
