A carpenter was yesterday fined $25,000 or in default three months’ imprisonment by Senior Magistrate Sunil Scarce after he made an appearance in the Georgetown Magistrates’ Courts to answer to an assault charge.
Elvis Davis, 42, of Soesdyke-Linden-Highway pleaded guilty but asked to explain when the charge was read. On July 10, last, at Soesdyke-Linden-Highway he allegedly assaulted Collin Daniels.
Police Prosecutor Aduni Inniss told the court that the victim and the accused are known to each.
The Prosecutor added that on the day in question Daniels was at a shop purchasing items when the accused who was sitting in the said shop consuming alcohol got up from his seat and approached Daniels. He took the items that Daniels had purchased and threw them onto the floor.
Daniels, on realizing what Davis was doing, asked him to desist since he had already paid for the items.
The accused then turned to the victim and told him that he was going to kill him if he did not keep quiet and allow him to throw the items on the floor.
The court heard that while the victim was leaving the shop the accused took a pair of scissors from his pocket and stabbed the victim to his back.
The matter was then reported to the station and the accused was later arrested and charged for the offence.
When given the chance to address the court the accused said “I really and truly did not know what transpired between me and him. I was under the influence of alcohol. Kindly give me another chance. This is the second time I drink and can’t remember what happened.”
The magistrate after listening to the accused told him that based on the current situation with the prison he will not send him to jail.
