Dear Editor,
I herein make reference to Mr. Sase Singh’s letter titled, “there is no justice for the poor and powerless,” published in the Kaieteur Newspaper on Wednesday January 25, 2017. I specifically am writing in relation to the DPP; Mr. Singh is absolutely right when he said that “it is time for the DPP to bite the bullet and surrender those cases she has inadequate evidence on.” Little does he know, it is precisely what the DPP does before a new criminal session commences in Demerara, Berbice and Essequibo.
Importantly, Mr. Singh’s letter underscores the continuous need for the DPP dissemination of her quarterly and end-of-year press releases, even though some sections of the print media think they are monotonous. If carefully read these press releases would explain why several criminal matters are nolle prosequi or for short, nolle pros, meaning, to abandon or to have the State dismissedthe charges against the accused.
Indeed, reporters from independent media houses have asked the tough question, why does the DPP nolle prosequi so many cases, but it is for the exact reason that Mr. Singh has pointed to, that of insufficient evidence or indeed, that the accused has spent a number of years on remand. Additionally, when police files are forwarded to these Chambers for legal advice, and when read through, if the statements therein do not support the charges instituted, the police are advised to withdraw the charges. This process is being followed all the time.
