A mixed jury was yesterday unable to reach a verdict into the murder trial of Rayburn Harvey, who was accused of the March 18, 2006 murder of Samantha Belle.
The prosecution’s claim is that Harvey, who was in the company of another man, robbed and killed Belle on March 18, 2006. The woman was shot multiple times about the body.
Yesterday as the mixed jury went into chambers for deliberation, the presiding Judge, Madame Justice Dawn Gregory, cautioned them on a number of aspects that they must cover if they wanted to come up with an unbiased decision.
State Prosecutors Rhondel Weever and Teshanna James, represented the Chambers of the Director of Public Prosecutions.
The jury went into deliberations shortly before 13:00hrs yesterday and returned five and half hours later. After returning to the courtroom the head juror, informed the court that a decision could not be reached.
The judge then remanded the accused and ordered a retrial, which will take place at the opening of the next session of the Demerara Assizes. Seven witnesses were called upon during the trial.
Superintendent Lawrence Kissoon had told the court that he had conducted an identification parade at C.I.D. Headquarters, Eve Leary, when Bell’s sister identified the accused as the man who allegedly shot and killed Samantha Belle on Vlissengen Road on March 18, 2006.
Following the identification, the accused denied that he was the killer, but was subsequently charged with murder.
The prosecution in their opening address said that they would lead evidence to prove that during a robbery on the night in question, the accused shot and killed Samantha Belle, 28.
According to the prosecution the evidence would be led to show that a post mortem examination would show that the woman died from perforation of the lungs due to multiple gunshot injuries.
Police Inspector Elston Baird, had stated that he was a detective inspector stationed at the La Penitence Police Station and attached to the C.I.D. as Inspector in charge of crime.
He told the court that he visited the scene and assisted with information.
Another witness, Supt. Lawrence Kissoon, told the court that on April 30, 2006, he met the accused at C.I.D. headquarters, Eve Leary. He told him that he, the accused, was a suspect, that in company with another man in the act of robbing Samantha Belle on the March 18, 2006, he shot and killed her.
He conducted the identification parade and Harvey was picked out.
