Dear Editor,
As an Attorney-at-Law, a Central Committee Member of the People’s Progressive Party, a Member of Parliament for the Government and one who spoke in support on the Legal Practitioner’s Bill in Parliament, I feel compelled to respond to a letter to the Editor signed by Ms. Juliet Holder-Allen, Attorney-at-Law, which appeared on page five of Kaieteur News dated 6th November, 2010.
In that letter, Counsel criticises the Bill on the ground that it is unconstitutional and challenges the Government to attempt to enforce the provisions of the Bill against her.
As regards the latter, the enforcement of laws is a function of the executive and I suppose those endowed with that responsibility will treat appropriately with the challenge launched by Counsel.
As regards the former, I have no doubt that Counsel is aware that ours is a constitutional democracy which permits judicial review of legislation.
This mechanism will allow Counsel to challenge the legislation for its constitutionality. If the legislation does not pass the test of constitutionality, then it is liable to be struck down to the extent of its inconsistency with the constitution.
However, it is in relation to the last three paragraphs of this letter with which I take umbrage. They read thus:
“There is one set of laws that are already in place which if they are activated will put the entire PPP and their descendants and supporters clean out of this country.
Just take care of yourselves. You are just visitors to this land.
Remember that.”
When I read the letter for the first time, the message conveyed thereof, both expressly and by implication, was excruciatingly plain.
However, because the author is a learned member of an honourable and noble profession who once held the high office of Chief Magistrate of this land, I dissuaded myself from that conclusion on the basis that such a person will not publicly express such an injudicious opinion.
In the circumstances and for purposes of clarity, I kindly request my learned friend to explain, both for my edification and the public’s benefit, the following:
(i) Which set of laws “will put the entire PPP and their descendants and their supporters clean out of this country”?
(ii) What do you mean when you label the PPP, their descendants and their supporters as visitors to this land? And finally:
(iii) If we are merely visitors to this land, where is our home?
I anxiously await your kind response.
