Dear Editor,
The recent remarks by Attorney General Anil Nandlall regarding the impending election of the Leader of the Opposition are as revealing as they are reckless. By using his platform to label a democratically elected representative as a “fugitive” and a “grave indictment” to the nation, the Attorney General is not acting as the impartial guardian of the law, but as the chief architect of a campaign of political persecution. His rhetoric suggests that the “indictment” of a foreign power should somehow supersede the “mandate” of the Guyanese people, a dangerous inversion of sovereign logic that ignores the foundational principle of the presumption of innocence.
It is a profound irony that the head of the legal affairs ministry would act as judge, jury, and executioner, using the term “fugitive” to describe a man who is currently engaging—not fleeing—the legal processes in the Guyanese High Court. By this logic, a mere accusation from abroad is sufficient to strip a citizen of their constitutional rights and invalidate the will of 109,000 voters. If the rule of law were truly the priority, the government would respect the judicial process rather than attempting to bypass it with public condemnations before a single trial has concluded. Furthermore, the AG’s attempt to characterise the Leader of the Opposition as an “alternative president” to justify his interference is a fundamental misreading of our system. The Opposition Leader is not an appointee of the government or a subordinate of the executive; he is the constitutionally mandated voice of the people who did not vote for the ruling party. To suggest that the executive should have a say in who fills that role is to advocate for a one-party state masquerading as a democracy.
Perhaps the most egregious aspect of this commentary is the attempt to wrap this persecution in the mantle of Dr. Cheddi Jagan. To invoke the “Father of the Nation” to justify the marginalisation of a political opponent is a desecration of Jagan’s true legacy. Dr. Jagan spent his life fighting against external interference and the abuse of state power—principles that are currently being sacrificed at the altar of geopolitical convenience. The current crop of leadership would serve themselves well to stop using Jagan’s name to sanitise their political agendas; none among them can compare to the man who stood for the “little man” and the sanctity of the ballot box.
The Attorney General’s fierce opposition to the January 26th election is not about the “reputation of the Commonwealth,” but about the fear of a formidable opposition. While the government conducts its business in places like Miramar behind the veil of “official correspondence,” they simultaneously lecture the public on morality. History will indeed judge this era, but it will not condemn the voters who demanded change. Instead, it will record the actions of those who tried to silence that change by weaponising the law. In this Republic, the Constitution remains a shield for the citizen, and the ballot remains supreme.
Sincerely,
Hemdutt Kumar
