Magistrate Moore was ‘caught’; abusing the discretionary powers given to him.
More like caught disregarding the laws by which he should have contemplated the punishment for Messrs Andre Luiz Pereira and Salem Nobrega De Alencar, both charged for entering Guyana illegally and with 453kg of cocaine. What is $50,000 for someone who clearly has access to lots of money, except a ticket to ‘flee’ the country?
Credos to AG Nandlall for being aware and alert and moving to the higher court to stall and thaw this aberration. Too often Magistrates are abusing their ‘discretionary’ powers in issuing bail in circumstances where ‘to the layman’ bail shouldn’t be issued. Or even dismissing or ordering periods of probation when it is clear that there was malice in the alleged acts.
Then there is another Magistrate who granted a mere $1M bail to someone who took another’s life, unprovoked.
There is an issue titled “Guidelines for Judges and Magistrates” regarding their conduct on the bench and how they issue/grant bail and or punishment. There needs to be a common standard.
