Kaieteur News – The U.S. Department of Homeland Security has published a proposed rule on the use and collection of biometrics in the enforcement and administration of immigration laws. The proposed rule would increase the total number of people who are required to submit biometric data from 3.9 million currently to 6.07 million. Comments on the proposed rule are due on October 13, 2020, with comments on associated proposed form revisions due on November 10, 2020.
What is biometrics? Biometrics or a biometrics appointment takes about 15 minutes and it is the process of capturing an applicant’s fingerprints and photo to ensure the applicant does not have a serious criminal record or any relevant prior immigration violations. Applicants who are in the United States will attend their biometrics appointment at a local USCIS office, relatively early in the green card application process. Applicants who are abroad will attend a biometrics appointment at the U.S. consulate. Visitors to the United States have their biometrics captured when seeking entry to the U.S. when they speak to an immigration officer or at the kiosk machines.
U.S. Department of Homeland Security and U.S. Department of State is required to collect biometrics from any applicant, petitioner, sponsor, beneficiary, or other individual residing in the United States for any immigration and naturalization benefit. See 8 CFR 103.2 (b)(9).
Tips for Biometrics Appointment:
1. Don’t be late for appointment. If you are late or do not show-up then your underlining immigration petition that was filed can be deemed abandoned and denied.
2. Have a valid government issued identification to present for entry into building. This can be a passport, driver’s license, green card, employment authorization card or state ID.
3. Take the appointment notice and any other receipt notices.
4. Rescheduling is not a good idea but if you have an unavoidable emergency then call the number on your biometrics notice to reschedule to another day.
5. Take any other documents requested in the appointment notice.
