Principal Magistrate Judy Latchman is slated to make a ruling on whether a prima facie case has been made out against the defendant Erwin Bacchus for the murder of Jason De Florimonte on the next occasion that the matter is called.
Bacchus, 45, of Fifth Avenue, Subryanville, is currently on remand for the offence. His Preliminary Inquiry is being conducted in the Providence Magistrates’ Courts.
Bacchus was not required to plead to the charge as it was made indictable. The charge alleged that on August 4, last, he murdered Jason De Florimonte.
The attorneys-at-law, Glenn Hanoman and Nigel Hughes, are representing the defendant in the matter. Yesterday when the matter was called the attorneys presented their no case submissions to the court.
The lawyers are contending that their client was trying to defend himself after he was attacked by De Florimonte who was at the time allegedly armed with a knife and a rolling pin.
After the submissions were made, the matter was adjourned until May 7, next, where Principal Magistrate Judy Latchman will make a ruling on the matter. The ruling will determine if there is sufficient evidence for the defendant to stand a High Court trial for a conviction.
Attorney-at-law Dexter Todd is representing the state in the matter. He was assigned to the case by the Director of Public Prosecutions (DPP) instead of a Police Prosecutor.
This was after De Florimonte’s relatives complained to the Police Complaints Authority and the Crime Chief about several alleged discrepancies involving the manner in which the case was being handled by the police.
According to reports from the police, on the day in question, around 01:00 hrs, De Florimonte, 30, of Lot 96 Fifth Avenue, Subryanville, was seen abusing a female. The handyman went to part them. Soon after, an argument ensued between them.
According to information, an autopsy conducted on De Florimonte, revealed that he was shot three times about his body.
