Everyone in this beautiful country of ours will agree that for the past three months, almost the entire population is gripped with confusion, stress, and uncertainty. Now it is obvious that some things went wrong, and still remain wrong. In school, we learned that where there is an effect, certainly there is a cause. Now the fact remains that if the cause is not identified, and removed, then the effect will always remain, or keep coming back, like a recurring decimal. With all the intelligent people, Layers, Judges, Parliamentarians, etc. we all remain curiously awaiting a verdict to be handed down by a court (CCJ) in a foreign country, about forty times smaller than Guyana downright shame, and disgrace.
In order for us to identify the cause, we need to look carefully, at the facts and figures:-
On the 21st December, 2018, a No Confidence Motion (NCM) was passed against the APNU/AFC Government, by the National Assembly, and clearly announced by the Speaker of the House. The Chief Justice, in the Supreme Court, confirmed, and ruled that the motion was valid. Two out of three Judges, rule in the Court of Appeal, that the NCM was not valid. In my opinion, these two judges are clearly saying that the National Assembly, the Speaker of the House, the Constitution, and the Chief Justice in the Supreme Courts, are all No Good, and not fit for purpose, because they over ruled everything that was already done legally. This is certainly one of the major causes of the whole confusion because these two Judges tried to fabricate a new type of mathematical formula, and invoke the new word “absolute”.
A few days ago, I heard someone saying that, “he thinks that when the Guyana Constitution, was designed, and written, there was no absolute Vodka in Guyana”, so the word absolute was never mentioned in the constitution.
Everywhere in Guyana, and around the world, whenever there is a competition, or games or anything else, if there are two parties or group contesting, when everyone party gets one, or more than one, more than the other, then that party becomes the winner, and the other party loses. Only in our Court of Appeal, the two Judges ruled that 34 is needed as a majority of 65 that means, one party has to get three more than the other party to win. All our school children know better than that. Shame!
Judges in Guyana are mandated to use the constitution, and the written Laws of Guyana, as their tools, when making a decision, or ruling. They have no right adding words to the constitution, or trying to amend it. This must always be done by the competent Authority, in the House of Assembly.
Now the other basic cause of the problem: – The President and Government Ministers, clearly refuse to accept the rulings of the National Assembly, the Speaker of the House, the Constitution, and the Chief Justice’s ruling, in the Supreme Court. In 2014, when we had a similar situation, with the PPP in power, there was no such confusion, or problems, everything was done orderly, until 2015, when APNU/AFC assumed power with thirty three seats as a majority. The two Judges in the Court of Appeal did not tell them, that they had to get thirty four seats as a majority.
I also think, it is very stupid for the Government to even mention, or say anything about Charrandass’ dual citizenship, because Charrandass was elected to sit in Parliament by the same Government. Not the PPP, and they used the same Charrandass’ vote for almost four years, to pass whatever they want.
On the night of the NCM, if the same Charrandass had voted for the Government, he would have been a good person. Now because he used his good judgment and voted against the Government, he became the illegal Judas.
Now where is the Government democracy? The PPP Leader clearly announced that they will not go back to Parliament, with any members, who have dual citizenship, because the constitution ruled against that.
A senior minister of the Government clearly announced that, they are going back to parliament, with all their members, including those with dual citizenship, regardless of the constitution or ruling. Now it is very clear, for everyone to see, and know, who is democratic, and who is dictator.
Last year, Minister Volda Lawrence clearly announced that she will employ, only people, who are PNC members. Is this fair? Where is the Human Rights with their big mouths? Now everyone can use their better judgment, and see: – The Basic causes of all the Confusion.
