Calvin Bailey, a convicted killer, who is currently serving a 15-year jail term for manslaughter was
yesterday, jailed again, for two years after he was found guilty of unlawfully wounding Dwain King, an inmate at the Georgetown Prison.
In mitigation, Bailey told the court, “To be honest to this court I did not inflict the injuries on Dwain King. Madam I respect the court and please be lenient with me.”
The two-year jail sentence will run consecutively with the 15 years.
According to reports, Bailey, formerly of Linden, stabbed King twice with an improvised knife during a clash at the Georgetown Prison. Prison source said that Bailey had alleged King, a prison orderly convicted for narcotics, had been in contact with Bailey’s girlfriend.
On November 8, 2016 Bailey appeared in court and pleaded not guilty to the charge.
However, yesterday Chief Magistrate Ann McLennan said that after reviewing the evidence in its entirety, what transpired at the prison on the day of the wounding (November 6, 2016) was crystal clear. She said that she disbelieved when the Bailey told the court that other inmates inflicted the injuries on King.
Bailey was charged in April 2007, for the murder of his 18-month-old son Shaquan Nero, which occurred during an altercation with the child’s mother, Bernadette Nero.
He was freed in March 2016 by Justice Priya Sewnarine-Beharry after a third hung jury trial.
In September, last year, King formerly of Lot 165 Stanleytown, West Bank Demerara was jailed for 60 months and fined $30,000 by Magistrate Latchman after she found him guilty of trafficking 2.9 kilogrammes of cocaine on November 20, 2015 at the Cheddi Jagan International Airport.
During Bailey’s trial, Chief Prison Officer Abeie De Cunha told the court that he was on duty on the day in question, when he received a report about an incident in the ‘New Wing’ Division.
De Cunha said he was told by a duty officer that Bailey allegedly assaulted King.
The Chief Prisoner Officer said that Prison Officer Williams escorted King to the ‘Front Gate Area’, where he observed injuries about his body.
“I observed a wound on his (King) upper left chest and a wound on his upper right arm. At that time he was bleeding and I instructed Prison Officer Williams to take him to the Georgetown Hospital.”
De Cunha related that the improvised knife was handed over to him by Prison Officer Williams. In describing the weapon, the witness said that it was a length of metal painted red on one side. The other side, he said, was “rusty”.
The matter was reported to the Alberttown Police Station and De Cunha handed over the improvised knife to Detective Sergeant Gilbert Ross.
Sergeant Ross testified that he visited the Georgetown Prison on November 7, and made contact with Bailey, King and Colin Smartt, who are also inmates at the prison.
The police witness said that he put an allegation to Bailey and he denied wounding King and also declined to give a statement. Sergeant Ross recalled visiting the scene of the crime at the ‘New Wing’ Division of the prison, where he observed what appeared to be blood on the floor.
The witness related that he lodged the knife with the Subordinate officer in charge of the Alberttown Police Station and later collected the medical in favour of King from the Georgetown Public Hospital Corporation (GPHC).
