Man, 66, freed of rape charge
… after virtual complainant declines to testify
A 66-year-old man on Monday walked out of the Berbice High Court a free man after the virtual complainant declined to give evidence against him. The matter was being heard before Justice Jo Ann Barlow and a mixed Jury.
The man, Winston Benn, of Limlair, Corentyne, Berbice is accused of committing the act on the girl who was under the age of 16. She was said to have been 14 years old at the time. The man allegedly committed the act between October 1 and October 31, 2013.
The virtual complainant informed the court that she is the mother of a two-year-old. She is employed and as such she wished to move on with her life. She had discussions with her mother and they came to the conclusion.
Justice Barlow then directed the Jury to return a verdict of not guilty.
