Corentyne hunter jailed for killing his lover’s husband

A hunter who shot his lover’s husband dead in 2008 was sentenced to nine years jail yesterday.
Justice Brassington Reynolds handed down the sentence after the 33–year-old accused, Wazim Bux, had pleaded guilty to manslaughter during his appearance in the Berbice High Court.
Bux, called Tom Boy, of Kilcoy, Corentyne, was on trial for murdering Ahmad Razack, a 45-year-old cane cutter of Kilcoy Front, Corentyne, on January 24, 2008.
The accused, who was involved in a relationship with Razack’s wife, shot him in his right ear at close range with a shotgun. Razack and his wife had allegedly gone to his in-laws’ yard at ‘Kilcoy Back’ to pick up bricks when he was shot.
Prosecutor and attorney-at-law Rhondel Weever stated that at around 5:30 pm on Wednesday, January 24, Bux, who was a licenced firearm owner and a hunter, ambushed and killed Razack.
According to the prosecutor, Razack’s 43-year-old wife, Bibi Zulikha, had stated that she and her husband had left home on separate bicycles to pick up bricks from her mother’s yard at `Kilcoy Back’ when the accused shot her husband. She said that the accused attempted to shoot her also and a scuffle ensued after he was not successful. He attempted to flee with her and threatened to kill her. She had stated how she had put up a fight before managing to escape.
A post mortem report showed that Razack died from shock and hemorrhage due to gunshot wounds.
Police recovered the licenced shotgun that was used in the killing.
A preliminary Inquiry was conducted at the Albion Magistrate’s court by Magistrate Chandra Sohan where a prima facie case was made out.
A probation report which was requested after the accused had pleaded guilty was presented by Probation and Social Service Officer Maisie Sheppard, and was in the accused man’s favour. The report stated that Bux was the eldest of three children. He left school at the tender age of 11 years to assist his parents and care for his younger siblings. His father is now ill and wheelchair-bound. The accused is the father of three children ages 13, 10 and nine. It also stated that his wife, Ramona Balgobin, has since abandoned the home which has since been sold and the children are now living with Bux’s parents. It also mentioned that members of his community and officials of the New Amsterdam Prison also spoke favourably about the accused.
Bux was given an opportunity to relate his side of the story upon a request by his attorney Kim Kyte-John, before her plea of mitigation. He stated that he and the slain man’s wife had an intimate relationship for over seven years. On the day in question she repeatedly called him on his phone and invited him over to her mother’s house. They were in the process of having sex when her husband walked in. He state that the man drew a cutlass and attacked them. A scuffle ensued and during the time he picked his licenced firearm and fired a shot at the deceased.
He stated that he only fired a shot at the deceased in self-defence and did not mean to harm anyone, and by using his gun he protected the woman and himself. He proceeded to say sorry to God, his children, the society and to the Judge.
The man went on to say that his former lover made up a story so as to protect herself, because she did not want her son, daughter and grandson to know what was going on. She was ashamed to let people know what transpired on the day that she was caught naked having sex with a “lil Boy”.
Attorney at law Kim Kyte-John stated how sorry and remorseful her client was. She noted that a life was lost, but the urged the court to take all the circumstances into consideration; that it was a life and death situation where Bux had to defend himself and lover. She quoted a number of authorities to support her pleadings. She mentioned that her client has spent over four years in jail and that should also be taken into consideration. She also mentioned that the accused did not waste the court’s time and referred to the probation report where members of the community and the prison authorities had nothing bad to say about her client.
Before passing sentence the judge stated that he had taken everything into consideration, including the accused man’s age, time spent and the favourable probation report. He also noted that the accused is the father of three young children who are left in the care of his parents.
