Yesterday, Magistrate Fazil Azeez recused himself from the Mark Benschop trial on a charge of assaulting a peace officer and resisting arrest.
The matter was called again yesterday in the Georgetown Magistrates’ Court and immediately the sitting magistrate announced that he would not be presiding over the matter.
He then sent it back to Acting Chief Magistrate, Melissa Robertson for it to be reassigned.
When asked by this newspaper why he recused himself from the matter, Magistrate Azeez said Benschop was once a former work colleague. As such he does not want to seem prejudiced in dealing with the matter, he said.
On November 2 last, Benschop was charged for assaulting a peace officer, Neville Jeffers, and also resisting arrest.
The matter was first called before Acting Chief Magistrate Melissa Robertson who placed Benschop on self-bail.
The matter stemmed from police officers in the company of the head of the National Frequency Management Unit trying to gain access to Benschop’s home with a search warrant.
