Forty- nine year old Junior Kendel and his two sons, Alvin Creame and Keon Grant, have been slapped with arms and ammunitions charges as well as one of inflicting bodily harm.
It is alleged that on September 8, last, Creame and Grant inflicted grievous bodily harm on Ron Mitchell at a North West location.
It is further alleged that on September 14, Creame had in his possession a .380 semi automatic pistol without being the holder of a valid firearm license.
Cream and his father were also charged for having three 9mm rounds in their possession without being the holders of a valid firearm license in force at the time.
Kendel, Creame and Grant all pleaded not guilty.
Representing the father and sons were Attorneys-at-Law Gregory Gaskin and Joe Harmon.
Gaskin argued that as it relates to the grievous bodily harm charge, Creame and Grant were acting in self defense. He told the court that the virtual complainant in question is a known burglar in the area, and was attempting to steal from his clients’ father, who is a popular shop owner in the area.
He described the charges against Kendel as ludicrous, and claimed that the evidence against his client was planted.
According to Gaskin, Kendel buys and sells minerals and fuel, as well as groceries in the North West District area of Big Creek Port Kaituma, where he lives with his sons who work along with their father as shop attendants. Gaskin told the court that Kendel is a man of great substance in the community, that his clients had no previous brushes with the law, and as such pose no risk of flight.
He further made applications for bail based upon the “trumped up charges and planted evidence” for all three of his clients.
The prosecution related that there was a confrontation between the virtual complainant, Ron Mitchell, and the defendants dealt him several lashes with a piece of wood. As a result of the beatings, the prosecution added, Mitchell suffered a broken arm.
Bail was refused for the little family and the matter was transferred to the Matthew’s Ridge Magistrate Court for November 3.
