Dear Editor,
I had read the entire decision of Justice Sandil Kissoon and concluded it was a well-reasoned, unassailable, solid decision that aligns with the law and with what National Hero Glenn Lall and Civil Society advocateshave been saying. When I listened to Justice Rishi Persaud, he seems to be saying the diametrical opposite of what Judge Sandil ruled. How can two Judges be so far apart like night and day on this Insurance ruling?
In an apparent rebuke and disappointment that Justice Kissoon’s decision did not favour Exxon but favoured the People of Guyana, to whom both the AG and VP sworn to preserve, protect and uphold in their oaths, the VP suggested courts must make “predictable” decisions. The VP appears to be saying that “predictable” decisions are good for attracting foreign investors. To my mind, this is quite a backward view of the law, especially if the suggestion is that you must screw your own country to kiss up to foreign interests.
This is reprehensible and traitorous. So did Justice Kissoon make a decision that was “not predictable” to Exxon and Justice Persaud made a decision that was “predictable?” Did anyone on the Government side guaranteed Exxon they will not allow legal decisions to go against them, that decisions will be “predictable” in accordance with what they will dictate? Did the VP hate Justice Sandil’s decision but liked Justice Persaud’s decision? To repeat, the People of Guyana is baffled that our own AG and VP rushed like Usain Bolt to announce an appeal against a decision that made the Oil Imperialists accountable for oil spills and for adequate protection of our environment by having proper insurance that will cover all costs in the event of an oil spill. The people want to know what would motivate our Government, Opposition and Private Sector to be on the same side on a single bed with Exxon, against the masses of Guyanese people.
While Justice Persaud’s ruling is seen as a temporary setback delaying Exxon’s day of judgement, all Guyana expects that the Full Court will uphold Justice Sandil’s ruling. Some people say if we fight the mighty Exxon in an American Court, we will not win. So why should Exxon win in our Guyanese Courts, when our poor country cannot pay decent minimum wages, salaries, and pensions, and we remain a s…hole country, while Exxon ships away the bulk of Guyana’s oil wealth? The People of Guyana are sovereign, and their interests are sovereign and paramount. Exxon must have no sovereignty over us! Never!
I predict that at the Full Court of Appeal, two of the three Appeal Judges will uphold Justice Kissoon’s decision. Exxon must not think it can engage in a frolic of its own and push us around, dictating what it will do or not do. They must comply with all our laws and our permits. They must pay taxes as they do in other countries. Guyanese must not sit back and allow Exxon to walk all over us with the connivance and facilitation of the Government, Opposition, and rapacious Private Sector in cahoots with them. Stand up for Guyana! Stand up for unlimited parent guarantee in paying for all liabilities in the event of any oil disaster. Wake up Guyana!
