DEAR EDITOR,
Keith Lowenfield and Claudette Singh stand accused of failing to deliver fair and transparent election result expeditiously to the Guyanese people.
The diabolical situation in Guyana is the direct result of these two persons’ deliberate actions and inactions resulting in the unfolding of a naked fraud.
There is no dispute whatsoever that the electoral process was conducted in a fair and transparent manner in all 10 Regions. The contents of the Statements of Poll (SOPs) are not being disputed and were never an issue of contention.
The law enumerates unequivocal procedures for the tabulation of the SOPs and the declaration of the results. However, Mr. Lowenfield refuses, fails and frustrates the tabulation. He has conspired with Clairmont Mingo to produce falsified tabulation of Region 4. He knew by direct observation and overwhelming evidence at his disposal that Mingo deliberately declared false results twice. He perpetuated the falsehood by signing and presenting the tabulation for the Commissioners’ adoption. At this juncture, he aided and abetted the false tabulation. He has committed an electoral offence.
Mr. Lowenfield has in his sole possession the original SOPs. The SOPs contain the authentic representation of the electorate choice of government. Why are the SOPs being ignored? It is simply because they revealed that the incumbent APNU+AFC lost and the opposition PPP won the election. Mr. Lowenfield and other employees of the GECOM secretariat and PNC Commissioners are frustrating the process. They are deliberately preventing due process in order to keep the losing incumbent APNU+AFC in power. These people are refusing to obey the mandated procedures for their own illegal purpose.
The GECOM chairman has been complacent throughout the whole process. She has failed miserably at carrying out her functions. GECOM is structured in a manner so as to cause the chairman to be the honest broker and to deliver fair and transparent election results expeditiously. The purpose of the laws and process surrounding the chairman’s appointment is to ensure impartiality. It is precisely for this reason, the unilateral appointment of James Patterson by David Granger was found to be a breach of the Constitution.
Claudette Singh needs to remind herself of the noble office she holds. She has the authority to demand the SOPs from Lowenfield and to complete the tabulation of Region Four. After all, the SOPs are not the personal property and chattel of Mr. Lowenfield. GECOM and, more directly, the chairman is the true custodian of the SOPs. Claudette Singh is failing in her statutory and fiduciary duty to take possession and secure the integrity of the SOPs. She must demand the immediate delivery of the SOPs by Lowenfield.
Claudette Singh knows and has evidence that the tabulation process by Lowenfield and Mingo is tainted with clear intention and actions to rig the election. She must assert her authority and remove these two persons from any further involvement. It is incumbent upon her to immediately report their illegal activities to the police and the DPP.
The Constitution at Section 162(1)(b) states that the Commission shall issue such instructions and take such action as appear to it necessary or expedient to ensure impartiality, fairness and compliance with the provisions of the Constitution. If ever there was a time to invoke this section of the Constitution it is right now.
There is no legal or practical reason preventing Claudette Singh to immediately restart the tabulation of the SOPs. The starting point must be from where Mingo and Lowenfield contaminated the process. There is no dispute as to the authenticity of the tabulation prior to this moment. Therefore, let’s not undo what has already been vouched as authentic and undisputed.
The Guyanese people and the rest of the world are watching and depending on Claudette Singh to take full responsibility and simply to do the right thing that she is statutorily required to do. She has a choice of sealing her legacy as either a heinous monster or an honourable judge.
Remember Justice Singh, if you fail Guyana fails. Don’t let the people cry on you.
