The woman who was on trial in the Berbice High Court on a charge of accessory after the fact, in the murder of a security guard, has been freed.
Lalita Bollers, 45, of Corentyne, Berbice walked out of court on Wednesday, a free woman after Justice Priya Sewnarine-Beharry upheld the defence’s no case submission.
Bollers was on trial for the incident which allegedly occurred on Sunday, April 1, 2018. It had been alleged that she had received and comforted her son Carlos Bollers, and Yuvraj Singh called “Renee”, knowing that they had murdered Munesh Prem Ayasammy Munien, called ‘Tad,’ in the course of a robbery.
Attorney-at-law Tanya Warren-Clements represented the accused. State Prosecutor Mandel Moore presented the state’s case.
Clements had earlier put forward a strong no case submission during which she quoted a number of authorities. She submitted that the Prosecution had to prove that the woman knew of the murder and that she did something to assist the accused persons after the murder. This was not done.
The attorney submitted that the woman did not know of any murder, in addition, if there was a murder, the prosecution failed to prove that the woman knew of the murder.
Clements also submitted that the element of murder was not proven by the Prosecution, so her client could not be found guilty of the charge of accessory after the fact to murder.
After listening to both the defence and prosecution submissions, Justice Sewnarine-Beharry concurred with the defence and directed the jury to return a unanimous verdict of not guilty and set the woman free.
The woman expressed thanks before quickly exiting the court room.
