It is very refreshing to read of the submission of Attorney Lalu Hanuman to the CCJ. We need more visionaries like him in our country.
The recommendation of the Speaker of the National Assembly (maybe there should be no functional National Assembly now), to be the Interim President seems excellent. I would be more inclined for the Speaker to be the interim Chairman of the Elections Commission.
Article 95 of our Constitution identifies the succession of President. The next office holder in line is the Prime Minister. However, if there is no elected President, then by extension there is no elected Prime Minister; hence the office of Prime Minister is also vacant.
Next in line is a Minister, who is an elected member of the National Assembly as Cabinet shall elect. Well, according to Article 106 (6), the cabinet has resigned. With no cabinet in place, no Minister can be appointed President.
With no Prime Minister and Cabinet, the next person in line is the Chancellor.
I trust that the submission to the CCJ included this recommendation.
