A miner, who the court heard is in the habit of collecting a quantity of food items, fuel and mining equipment, from businesses in the interior locations, was yesterday remanded to prison for the next three months, after being slapped with two counts of obtaining credit by false pretence and one of fraudulent embezzlement.
Thirty-two-year-old Rudolph Braithwaite, who told the court he resides at Lot 6 Public Road, McDoom, East Bank Demerara, appeared before Senior Magistrate Faith McGusty in the Georgetown Magistrates’ Courts.
He is accused of obtaining a quantity of fuel, food stuff and mining equipment worth over $5M on the account of his employer Neville Rutherford.
Particulars of the first charge alleged that between April 27 and June 7, 2018, at Imbaimadai Landing, Mazaruni River, with intent to defraud, he obtained a quantity of mining equipment and food articles worth $313,000 – property of Devika Persaud, by falsely pretending that the items were bought on the account of his employer, Neville Rutherford.
The second charge alleged that, between January 1, 2018 and February 28, 2018, also at Imbaimadai Landing, Mazaruni River, he obtained a quantity of goods and fuel worth $580,000, property of Grant Ali, by falsely pretending that the items were bought on the account of his employer Neville Rutherford.
The last charge stated that, between December 1, 2017 and July 9, 2018, he fraudulently embezzled 19 ounces of raw gold, worth $4.9 M, from his employer, Neville Rutherford.
An unrepresented Braithwaite denied the allegations after they were read to him.
Facts presented by Assistant Superintendent of Police (ASP), Stephen Telford, stated that the defendant is in the habit of committing such crimes in the interior locations.
The Prosecutor added that after the defendant committed the offences, he fled the area.
Police were able to arrest him a few days ago after Police acted on information gathered.
The Prosecutor objected to bail being granted to the defendant citing the fact that, when he was arrested, Braithwaite gave ranks his address as Lot 150 Middle Road, La Penitence.
When asked by the Magistrate where he resides, Braithwaite told the court that he lives at Lot 150 Middle Road, La Penitence. The Magistrate, who had a shocked look on her face, stated, “Please explain that to me, because I grew up in that area and there is no such thing as Lot 150 Middle Road, La Penitence.”
Braithwaite replied by saying, “That’s where I have been living for the past five months, so I don’t know.”
The father of two was instructed to make his next court appearance on March 19, 2019.
