Three men who were on trial in the Berbice High Court on two criminal charges walked out of the Court as free men after the Jury in the matter returned not guilty verdicts on both counts.
The men are Rajnarine Isree, 50, called Dave; his son Kumar Isree, 23, and his nephew Sandeep Toolsie, 21, all labourers of Bush Lot West Coast Berbice.
They were on trial for attempted murder and wounding with Intent to maimed, disfigure or cause bodily harm to Henry Garrett, 31, a labourer of No 22 Village, West Coast Berbice, before Justice Priya Sewnarine Beharry and a mixed jury.
The incident is alleged to have been committed on March 13, 2016 at a wedding House at Middle Dam Bush Lot, West Coast Berbice.
The men were represented by attorneys at Law Tajenarine Ramroop and Arud Gossai. Attorney at law Mandel Moore prosecuted the state’s case.
The prosecution case was that before 1:00 am on the day in question the men were all at a wedding house at the above address.
The victim left to go and check on his bicycle which was on the dam. On his way back the three accused stopped him. Ramnarine Isree asked him, “Wat a No 22 man a do a Bush Lot”.
Garrett replied, “Ah come check out the wedding House.
With that the three men pounced on Garrett and dealt him a severe beating about his body. He suffered lacerations to his head and injuries to various parts of his body including broken bones.
He fell unconscious and woke up in the hospital. He was first rushed to the Fort Wellington Hospital before being transferred to the New Amsterdam Hospital.
The prosecution called six witnesses including Woman Police Sergeant Joanne Johnson and Ex Police officer Quincy Calder.
The doctors reports had given the injuries as life threatening.
Justice Beharry took less than two hours to sum up the evidence to the jury. The jury after deliberating for just about two hours returned with not guilty verdicts.
Attorney at law Ramroop had contended that although there was a fight a number of persons were involved in what he termed brawl and it cannot be sure who injured the accused.
