Ramanand Jagdeo who is charged with causing death by dangerous driving, on Tuesday told the court that it was the pedal cyclist who rode into the path of his vehicle which was traversing along the Peter’s Hall Public Road.
Jagdeo, who has retained Attorney-at-Law Paul Fung-a-Fat, pleaded not guilty to the charge which alleges that on February 22, at Peter’s Hall Public Road, East Bank Demerara, he drove motorcar PRR 4395, in a manner dangerous to the public, thereby causing the death of Alexander Appiah.
According to reports, Jagdeo was driving a car, proceeding south along the eastern carriageway of Peter’s Hall Public Road, when he collided with the pedal cyclist who was riding in the same direction.
The court heard that the left front of the car hit the cyclist, hurling him from his bike and causing him to fall onto the roadway. As a result of the impact of the collision, the cyclist’s right leg was severed.
The injured man was picked up and rushed to the Georgetown Public Hospital where he was admitted. He later died.
When his trial continued on Tuesday before Chief Magistrate Ann McLennan at the Georgetown Magistrates’ Courts, Jagdeo opted to give unsworn testimony after the close of the prosecution’s case which was led by Police Inspector Neville Jeffers.
According to the defendant, on the day in question he was heading home to Golden Grove, East Bank Demerara, and en route, he stopped on the Back Road to pick up some items. He told the court that he then drove to Alexander Village, Georgetown, where he met his brother.
Afterwards, Jagdeo said he drove to M&M Snackette from where he bought some roti. He said that while heading along the East Bank Demerara Public Road in the vicinity of Peter’s Hall, he saw several persons walking on the left hand side of the road.
“Suddenly, I saw a bicycle coming over the road to my lane. I suddenly pulled brakes and when I stopped and came out of my vehicle a set of people flocked me and started beating me. They began cuffing me to my face and my head and stole my money,” Jagdeo recalled.
The defendant told the court that sometime after, police ranks arrived at the scene and escorted him to the Providence Police Station.
In making a no-case submission, Fung-a-Fat submitted that the prosecution had failed to make out a case against his client.
The lawyer that the prosecutor failed to prove the elements of the offence and, more so, that his client drove in a dangerous manner which resulted in the loss of a life.
In response, Prosecutor Jeffers submitted that from the statement given to police by Jagdeo, it can be inferred that he was driving in a dangerous manner at the time.
The prosecutor pointed out that Jagdeo failed to proceed with caution even though he saw pedestrians traversing in their numbers to the National Stadium where a J’ouvert was being held.
On Tuesday, the Chief Magistrate will rule on whether Jagdeo is guilty or not guilty of the offence.
Right now, the defendant is out on $1M bail.
