Dear Editor,
I tried it before but got no comment on it and no Judicial Officer paid any attention to it. We have seen and heard of persons being charged with being in possession of Narcotics and also of being in possession of Firearm and said persons are remanded, bail having been denied.
I do not see an issue if one is arrested on suspicion and so it is quite in order to have a person arrested for being in possession of ‘leaves, seeds and stems’, suspected to be a narcotics. To have that person charged and brought to court and then remanded is wrong. Unless the DPP has that substance tested and be deemed a ‘Narcotic’ there should be no charge.
The DPP has to take time to have it tested and so determined before charges are laid. Unless the substance is deemed to be an illegal substance that file should be classified as ‘incomplete’.
The same should be for ‘firearms’ charges. Unless a gun is tested by the competent authority and found to be a firearm no person should be charged with ‘being in possession of a firearm, without a licence’.
We are the ONLY country in the world where a person is prosecuted on merely a suspicion. Please Madame DPP and all the legal minds out, there let this be resolved.
