A 20-year-old man who was allegedly caught with a gun and eight matching rounds in his pants crotch was yesterday charged and remanded to prison.
Nickel Hutson of 29 Green Acres, Providence, East Bank Demerara, appeared before Chief Magistrate Ann McLennan in the Georgetown Magistrates’ Courts where two charges were read to him.
The first charge alleged that on June 26 at Robb Street, Georgetown, he had in his possession one 9mm pistol without being the holder of a firearm licence enforced at the time.
It was further alleged that on the same day and at the same location, he had in his possession eight matching rounds when he was not the holder of a firearm licence enforced at the time.
Hutson denied the allegations after they were read to him.
His attorney, Siand Dhurjon in an application to secure bail for his client told the court that Hutson, who is an active member in church, was “at the wrong place at the wrong time”.
He added that his client was in the back seat of a motor car which had multiple passengers at the time of the search.
The lawyer went on to tell the court that his client informed the police that he received the gun from a man name Trevor, at Robb Street, and he handed over the gun and ammunition to a taxi driver.
However, Police Prosecutor Gordon Mansfield told the court that his facts significantly differed from that of the defence. He told the court that on the day in question, ranks from the narcotics branch conducted a sting operation which caused them to go to Robb Street in the vicinity of Nigel’s Supermarket.
The ranks then positioned themselves and they observed Hutson exiting one car and entering another car, a short distance away.
The court heard that Hutson spent about five minutes in the latter vehicle and while heading back to the first car, he was observed acting in a suspicious manner.
As he entered the back seat of the car, he was intercepted by ranks and a search was carried out on him, and it was then that the gun and ammunition were found in his pants crotch.
Huston, when shown the articles, told the ranks that “a fat man name Trevor” gave them to him.
He was then arrested and taken to Criminal Investigation Department (CID) where he gave police a caution statement.
Magistrate McLennan after listening to the Prosecutor’s submission told the court that no special reasons were outlined to grant bail, hence she remanded Hutson.
He was instructed to make his next court appearance on July 18 before Senior Magistrate Fabayo Azore who will be conducting the trial.
