Desmond August Gordon, called ‘Tall Man’, 52, the cane cutter of Lot 196 Mangrove Street; Rose Hall Town, Corentyne, Berbice who was on trial before Justice Brassington Reynolds and a mixed Jury in the Berbice High Court for killing his wife, was jailed for 10 years.
His sentence followed a probation report which was ordered by the Judge.
Gordon was charged with murdering his reputed wife, Bhagmattie Angad, called “Bhagmattie Etwaroo”, “Kamini”, and “Kamani Etwaroo”, 50, a housewife of Rose Hall Town, Corentyne, Berbice on May 16, 2016 at their Rose Hall Town home.
But he pleaded guilty to the lesser count of manslaughter.
The probation report was presented by Probation and Social Service Officer, Maisie Sheppard. It highlighted that the accused was born and lived his early life on West Coast Berbice.
He is a father of five and the fourth of 10 children born to his parents. He dropped out of school at an early age due to financial constraints and began to work as a labourer with many businessmen and farmers.
He subsequently began working as a cane cutter at the Albion Estate.
It stated that Gordon was involved in two relationships before hooking up with the deceased. They have no children together, but she has children of her own.
It was reported that the woman was addicted to cocaine and marijuana and had developed a promiscuous lifestyle. They both were heavy consumers of alcohol and involved in numerous fights.
The accused was very remorseful and regretted what has occurred.
The report went on to state that the Gordon was a disciplined and well mannered inmate whilst incarcerated. He always adheres to the rules. He was once admitted to the National Psychiatric Hospital back in 1998.
Attorney-at-law Tuanna Hardy presented the State’s case. The couple had been together for about eight years and reportedly shared a very abusive relationship. They were imbibing during the day when an argument subsequently erupted.
Loud screams were heard coming from the premises following which the woman was seen running from the house with Gordon in hot pursuit. He had a cutlass in his hand. He reportedly used it to inflict several incised wounds about her body, including her head and neck.
The accused was seen with blood about his body. He was subsequently arrested and charged.
A postmortem examination conducted by Dr Vivikanand Brijmohan showed that death was due to shock and haemorrhage due to multiple incised wounds.
In a plea of mitigation, Defence Attorney Sasha Roberts of the Legal Aid Clinic begged the court to temper mercy with justice. She said that her client has thrown himself at the mercy of the court. He did not waste the court’s time.
Even though a life was lost, the probation report has shown a number of good qualities of the accused.
She said that with all that her client went through, he managed to stay strong, but it was a moment of weakness that a life was lost.
Before passing sentence, Justice Reynolds told the accused that his circumstance was a nature of his own circumstances and socialization. A life has been lost and you must suffer the penalty.
It helps that you did not waste the court’s time. It helps that you have been a model prisoner.
Given the life expectancy of men in Guyana is at 63 years. I will start between 18 to 25 years. I will start with the lower figure. The Judge subtracted five years for the guilty plea, two for time served and one for his good conduct leaving a number of 10 years.
