This is a correspondence of information that may be relevant to Legal Permanent Residents who have been deported from the United States. It is to my findings that the United States governments have been violating the very constitution of the United States they swore to uphold.
I have sought several Legal interest groups and surprisingly not one I have solicited is willing to challenge Social Security Act 42 USC 402 (n) which provides termination of benefits payable to an alien who has been deported.
The constitutional violations are discussed in Flemming Secretary of Health, Education and Welfare –V- Nestor The Supreme Court Case 36 US 603; 80 s Ct.1367; 4L.ED 1435; 1960 US Lexis 917 No 54. The unlawful taking of Legal Permanent Residents Social Security Benefits who have been deported.
The Constitution stated 7 th and 14 Amendments: Amendment VII
In suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise reexamined in any court of the United States, than according to the rules of the common law.
14th amendment: Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
A Three panel Appeal Court judges dissented that the Act 42 U.S.C.S 402 (n) is Unconstitutional Black J, Douglas J, and Brennan J agreed. That Social security Act 42 USC 402(n) is
1) Ex post facto: punishment without judicial trial
2) A bill of Attainder
3) Violation of due process taking an alien legal property
4) Civil rights are being violated due to my immigration status.
5) Discrimination
6) Labor Laws
These violations I have been subjected to. I was admitted legally in to the United States as of 1972, worked 10 years, earned my 40 Qualifying quarters under the social security acts 42 USCA 401 & 402 (T) (4) and 8 USCA 1645
Registered to vote in 1988 and voted in General elections 1992, 1993, 1996 & 2000 whereas I have a voters Number.
Registered for selective service 1988 with a selective service number.
This bill s7879-2013 New York State Citizen regardless of immigration status would grant me such State citizenship
However, Following an article in the New Jersey Law Journal dated March 28, 2005 on page S39 titled ESF Funds which goes to say.” The earnings suspense file is a fund that has an estimated $421 billion which represents in large part of social security taxes that were withheld from individual alien’s wages”.
Query of questions to present.
1) Is this the organization who keeps the social security funds of people deported?
2) If not then who keeps the social security funds of legal persons with social security numbers who have been deported?
3) is it a factual Bill of attainder Act 42 U.S.C.S 402 (n)
4) Can a son or daughter of a deportee claim for such funds
5) and who if any attorney interest group, political party has pursue such injustice?
So many are the political parties & interest groups who say they have a vested concern about DACA, Immigration, Deportation and all the elements that immigration law violates. One needs to bring this theft to the forefront, because if you are deporting them at least give them what they have labored for so they can start a new life in another country.
