The murder trial of Mark Trevor Greaves, came to an abrupt end yesterday after a no- case submission by Defence Attorney, George Thomas was upheld by the Court.
Greaves was accused of fatally stabbing Owen Frederick, a/k “Fluffy” on Christmas Day 2015. The matter commenced before Justice Navindra Singh and a 12-member mixed jury at the High Court in Georgetown on Wednesday.
Greaves, 56, of Albouystown, Georgetown, pleaded not guilty to the murder indictment on his arraignment.
Following a no-case submission yesterday, Justice Singh directed the jury to formally return a not guilty verdict. The Judge had explained to the panel that issue of self defence had been raised by Attorney Thomas and the Court was inclined to agree with the defence based on the evidence provided in the matter.
The Judge said that in light of the circumstances the Court found that there is insufficient evidence by the State to convict the accused for murder. Greaves was therefore released from custody.
The State called approximately seven witnesses to testify in the matter when commenced on Wednesday, last.
Prosecutor Abigail Gibbs in disclosing the facts of the matter said that on December 25, 2015, Greaves and Fredericks were involved in a heated argument.
The Prosecutor said that during the argument, Greaves stabbed Fredericks to the neck.
She said that the injured man was rushed to the hospital where he later succumbed to his injuries.
The State called at least seven witnesses including Police Constable Detective Leslie Williams, who is attached to the Crime Laboratory at the Criminal Investigation Department (CID) Eve Leary, Georgetown.
Constable Williams, a Police Photographer, said that on the day in question he visited the crime scene at Lot 33 James Street, Albouystown, Georgetown, where he took several photographic exposures of what appeared to be suspected bloodstains on the northern side of the lot.
After capturing the photographic exposure, the witness said that he returned to the Crime Laboratory and printed several photographs.
The detective said that on March 9, 2016, he tendered the photographs which were admitted as evidence during a Preliminary Inquiry in the Magistrates’ Courts.
Also testifying was former Police Constable Xavier Vasconcellos whose testimony was taken via Skype from Miami. Vasconcellos recalled that on December 25, 2015, he was performing duties at the Ruimveldt Police Station when about 19:00hrs, he was instructed by Inspector Herbert Henry to escort Greaves, who was a prisoner at the time, to Diamond Diagnostic Centre, East Bank Demerara.
According to the former cop, on arrival at the hospital, Greaves was seen by a doctor after which he was escorted to the Golden Grove Police Station, East Bank Demerara, where he was placed in custody.
Inspector Herbert Henry, the Officer in Charge of Crime at the Ruimveldt Police Station was among the other witnesses who testified.
